Galveston man sues Houston repair worker, alleging failure to perform tasks

A Galveston man is suing a Houston repair worker, alleging the defendant never performed agreed-upon work on the plaintiff's truck.

Luciano Zuniga Sr. of Galveston filed a lawsuit Oct. 29 in Galveston County District Court against John Beasley of Houston, alleging breach of contract.

On Aug. 21, 2009, the suit states, the two parties agreed Zuniga would hire and pay Beasley for various maintenance and reconstruction work on Zuniga's 1954 Chevrolet truck. Zuniga made multiple payments exceeding $8,000 to Beasley, the lawsuit says.

The suit alleges Beasley moved repair shops and confiscated Zuniga's vehicle without telling him, and that the plaintiff has made several unsuccessful attempts to contact the defendant and find his vehicle.

The contract was left unfinished and the vehicle never returned, the suit alleges. As a result, the plaintiff has suffered financial losses of approximately $22,000, according to the suit.

Zuniga seeks monetary relief of less than $100,000, including damages, penalties, costs, expenses, prejudgment interest and attorney fees. He is represented by attorney Katy Jo Muncie of Galveston.
