Two Harris County workers sue Hunan Plus Restaurant, allege unpaid overtime

Two Harris County men are suing their former employer, a Houston Chinese restaurant, alleging unpaid overtime and minimum wages.

Manuel Beletzuy Mendez and Flavio Beletzuy Mendez filed a lawsuit Nov. 3 in the Houston Division of the Southern District of Texas against Fang Investment Corporation, doing business as Hunan Plus Restaurant and Li F. Zhang, individually and doing business as d/b/a Fang Investment Corporation, alleging unpaid overtime and minimum wages in violation of the Fair Labor Standards Act.

According to the suit, during the time Manuel and Flavio Mendez were employed by the defendants as cooks, they regularly worked more than 40 hours per week and were paid a fixed rate twice a month. The suit alleges the plaintiffs were not paid an overtime premium for time worked more than 40 hours per week.

The lawsuit also alleges the defendants failed to pay Manuel Mendez minimum wage.

The plaintiffs seek to recover unpaid wages, unpaid overtime wages, liquidated damages, costs of the suit and attorney fees. They are represented by attorneys Mark Siurek in Houston and (of counsel) Patricia Haylon of Warren & Haylon in Houston.
