Ex-worker alleges Wastewater Specialties did not pay him overtime

A former employee is suing an environmental services company, alleging unpaid overtime.

Tommy Breed, individually and for all others similarly situated, filed a collective action lawsuit Nov. 5 in the Beaumont Division of the Eastern District of Texas against Wastewater Specialties, alleging unpaid overtime wages in violation of the Fair Labor Standards Act.

The suit states Breed was employed by the defendant from May 2013 to September 2015. The complaint alleges the defendant did not pay Breed and other similarly situated employees an overtime premium for time worked more than 40 hours per week, but instead paid them straight time for so-called "unbillable" hours.

Breed and others in the class seek to recover overtime compensation, liquidated damages, interest, attorney fees and costs. Breed is represented by attorney John Werner of Reaud, Morgan & Quinn in Beaumont.
