A Houston County man is suing Ford, alleging he was injured as a result of a defective vehicle.
Charles Moffett Jr. filed a lawsuit Nov. 9 in the Houston Division of the Southern District of Texas against Ford Motor Company, alleging negligent design, manufacture, assembly, marketing and/or testing of a vehicle.
On Oct. 9, the suit states, Moffett was driving a 2007 Ford F150 southbound on U.S. Highway 59 in Fort Bend County, when his truck was struck from behind, causing it to leave the roadway and strike an embankment. The suit says Moffett was properly seated and wearing a seat belt, yet he was still seriously injured.
The complaint alleges Ford was negligent in manufacturing and designing an unreasonably dangerous and un-crashworthy vehicle. As a result, the lawsuit states, the plaintiff sustained serious injuries, pain and suffering, emotional distress and mental anguish, impairment and disfigurement, loss of enjoyment of life, loss of wages and earning capacity, and medical expenses.
Moffett seeks actual damages, interests and costs of the suit. He is represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas, and by attorney L. Lee Thweatt of Terry & Thweatt in Houston.
