A Galveston County homeowner is suing a construction company, alleging it walked out on a home construction contract.
Eric C. Miller filed a lawsuit Nov. 10 in Galveston County District Court against U S Construction Services, alleging breach of contract, fraudulent inducement, fraudulent and negligent misrepresentation and deceptive trade practices.
On Feb. 16, the suit states, the parties entered into a contract for the construction of Miller's residence at 811 Elm, Clear Lake Shores. After the contract was executed, U S Construction began work on the home, but construction was substantially delayed, according to the suit.
The lawsuit alleges the defendant then performed defective work on the home but when Miller requested the work be remedied, the defendant refused and walked off the job permanently.
Miller was forced to hire new labor, resulting in a higher cost because U S Construction had grossly underestimated the cost of the job and misrepresented the use of multiple bids to obtain the best prices, the suit says. U S Construction has also failed to respond to demands for refund, the suit states.
Miller seeks damages, interests, attorney fees, and court costs. He is represented by attorney Frederick L. Fuhr of the Fuhr Law Firm in League City.
