A Beaumont longshoreman is suing a Houston shipping company, alleging negligence for on-the-job injuries the plaintiff says he sustained.
Stevie Flemon filed a lawsuit Nov. 10 in Jefferson County District Court against Trans-Global Solutions of Houston, alleging negligence.
On June 25, the suit states, Flemon was working as a longshoreman, loading military equipment onto railroad flat cars, for James J. Flanagan Shipping Corporation at the port of Beaumont and was driving a mine-resistant ambush protected vehicle (MRAP), which was to be loaded on a railroad flat car.
When attempting to drive from one flat car to another, the flat cars separated, causing the MRAP to fall onto its right front, the suit says, injuring Flemon.
Trans-Global performed railroad switching operations at the port of Beaumont, the suit states, and was responsible for the condition of all cars on its line. The suit alleges Trans-Global was negligent in the manner in which it switched the cars, as couplers were not properly coupled together, brakes were not set, and/or something was broken in one or both of the couplers involved in the accident.
As a result, Flemon, 56, sustained injuries to his lower back, neck, and right shoulder, and he has not been able to return to work, the lawsuit states. The suit alleges the plaintiff also sustained loss of wages and earning capacity, physical impairment and mental anguish, pain and suffering, and medical expenses.
Flemon seeks damages, interests and court costs. He is represented by attorney Steven C. Barkley of Beaumont.
