Two League City residents blame insurance firms, agent for not procuring coverage

Two League City residents are suing two insurance companies and an agent, alleging they did not procure automobile insurance as directed.

Vincent Smythe and Summer Molander filed a lawsuit Nov. 18 in Galveston County District Court against Progressive County Mutual Insurance Company, Town & Country Insurance Agency, doing business as Cadence Insurance, and Trishelle Antley, alleging negligence, gross negligence, breach of fiduciary duty, breach of contract, deceptive trade practices, breach of good faith and fair dealing, conversion and negligent misrepresentation.

According to the complaint, on June 19, Smythe and Molander bought a Mercedes ML 350 and purchased automobile insurance with Antley, an agent of Cadence, through Progressive. On Sept. 7, the suit states, the plaintiffs were involved in an automobile accident.

At the time, the plaintiffs believed their Mercedes was covered. However, the suit alleges, Antley and Cadence failed to procure insurance on the vehicle as promised. The suit says if Antley and Cadence did procure insurance, Progressive wrongly denied coverage for a valid claim.

As a result, the plaintiffs are personally liable for damages that should have been covered under insurance they previously sought, the suit says.

Smythe and Molander seek damages between $200,000 and $1 million, including any damages, penalties, costs, expenses, interests, costs of the suit and attorney fees. They are represented by attorneys Clint Brasher and Joe Muckleroy of Beaumont.
