HOUSTON – A computer engineer is suing is Dallas-based insurance company, alleging failure to pay long-term disability insurance benefits.
Wilfred Brasseur filed a lawsuit on Dec. 8 against Life Insurance Company of North America in the Houston Division for the Southern District of Texas alleging a violation of the Employee Retirement Income Security Act.
According to the complaint, on April 23, 2014, Brasseur, a computer engineer earning $159,748 annually, filed a claim for long-term disability insurance benefits. The lawsuit says he was paying 100 percent of the disability insurance premium with post-tax dollars.
On May 9, 2014, according to the suit, Brasseur was suffering from severe depression and anxiety, and that the condition was work-related. His psychiatrist recommended counseling in addition to treatment, the suit says, but on May 22, 2014, Life Insurance Company of North America denied his applications for benefits.
Brasseur seeks recovery of benefit due under the terms of the plan and enforcement of his rights, plus court costs. He is represented by attorney William C. Herren of Houston.
