Seaman alleges owners of shrimping vessel won't pay for his injuries

GALVESTON – A seaman is suing the owners of a shrimping boat, alleging they refused to adequately take care of his injuries when he fell 12 feet from a ladder while out to sea. 

Jose Luis Hernandez Medina filed a lawsuit Dec. 7 against Miss Winnie Inc. and Edward Garcia Sr. of Palacios in the Galveston Division of the Southern District of Texas, alleging negligence and willful failure to pay for his injuries. 

According to the complaint, on June 21, the Miss Winnie was shrimping in the Gulf of Mexico off the coast of Louisiana, when was Medina  instructed to grease the fishing equipment, which required him to climb a ladder on the mast of the boat. The suit says Medina fell 12 feet when a large wave hit the boat and suffered serious injuries. 

The lawsuit states Garcia gave the plaintiff $140 so he could see a specialist, but provided no other financial assistance. 

Medina seeks pre- and post-judgment interest, cost of suit and attorney fees. He is represented by attorney Joseph M. Gourrier of The Gourrier Law Firm PLLC of Houston.
