Insurance company alleges investment firms negligent in non-coverage claim

TYLER – An insurance company is suing a Boerne investment business, seeking to get out of paying a claim in a fatal vehicle crash.

Western World Insurance Company filed a lawsuit Dec. 16 against Carlton Investments Inc. of Boerne, Meyer & Meyer Investments Inc., doing business as Autumn Wood LLC, and the estate of Benjamin Sanchez in the Tyler Division of the Eastern District of Texas, alleging negligence and a liability insurance action for declarations of non-coverage. 

According to the complaint, on March 7, David Denman, while working as an employee of Meyer & Meyer, traveled onto the wrong side of the roadway on state Highway 31 in Gregg County and struck a vehicle, which killed the motorist, Benjamin Sanchez, and injured his wife and their two children. 

The lawsuit says, Denman was working on-call on behalf of his employer, Meyer and Meyer and was on a special mission. Western World Insurance, Meyer & Meyer’s insurance carrier, alleges Meyer & Meyer was responsible for the acts of its authorized employee at the time of the crash.

Western World Insurance seeks unspecified damages, plus legal costs. It is represented by attorney Robert G. Hogue of Dallas.
