Crane operator alleges Dynamic Downhole Services violated FLSA

MARSHALL— A crane operator is suing his former employer alleging that he was deprived of overtime pay.

Ricky L. Havard filed a complaint in the Marshall Division of the Eastern District of Texas against Dynamic Downhole Services LLC alleging violation of Fair Labor Standards Act (FLSA).

Havard was employed by the defendant from 2008 until 2015. During his employment, he operated a crane and often worked in excess of 80 hours, the suit states. Although Havard was paid a monthly salary of $10,000 plus 3 percent on tickets for work that he performed, he was not paid overtime wages of one-and-a-half-times  the normal hourly rate, the suit claims. 

Havard seeks damages for unpaid back wages, liquidated damages and legal fees. He is represented by Shane McGuire of The McGuire Law Firm PC in Tyler and Christopher C. Hughes in Nacogdoches.
