Modica Brothers Ltd. sued by employee claiming he suffered work-related back injury

BEAUMONT— Modica Brothers Ltd. is being sued by an employee who claims his back was injured while performing a task at work.

Daryl Martindale filed a complaint on Jan. 11 in the Jefferson County District Court against Modica Brothers Ltd., alleging negligence.

According to the claim, the plaintiff was employed by the defendant at the time of the incident and was completing a work-related task when he was injured. On Feb. 12, 2014, Martindale alleges he was in the act of removing a large tire when he was injured. The lawsuit states the defendant is a non-subscribing employer, which left the plaintiff without access to worker's compensation. Martindale is suing the defendant for alleged negligence related to the incident.

Martindale seeks damages for medical damages, loss of earning capacity, physical impairment and pain, as well as mental anguish and legal fees. He is represented by Jonathan C. Juhan and J.J. Bragg in Beaumont.
