Customer alleges Randy's Marine failed to properly repair vessel

Contractbreach

GALVESTON — A customer is suing a Galveston County boat business, alleging the repair of his vessel was defective.

Harry Schubeck Jr. filed a lawsuit Jan. 19 in Galveston County District Court against R & D Brokers, doing business as Randy's Marine, alleging deceptive trade practices.

According to the complaint, Schubeck hired Randy's to complete repairs to his vessel. The plaintiff and defendant were part of a contractual agreement, under which the defendant should have completed the repairs to the satisfaction of the conditions outlined, the suit says.

The lawsuit states Randy's breached the contract by failing to perform the repairs in a satisfactory manner, despite receiving payment from the plaintiff.

Schubeck seeks up to $3,113.67 for damages received, as well as legal fees. He is represented by attorneys William C. Boyd and S. Scott Boyd of Patterson, Boyd & Lowry PC in Houston.
