HOUSTON – A resident of Humble has filed a writ demanding that an Equal Employment Opportunity Commission administrative judge hear his discrimination case against the federal government.
Harold Gause filed a writ of mandamus on Dec. 15 against the U.S. Department of Defense, Capt. Olsea Collins, Joseph Kinlin, the National Archives and Records Administration, Scott Levins, James Springs and two unknown employees in the Houston Division of the Southern District of Texas, citing violations of the Privacy Act.
In or around about March 2013, Gause claims that he received a tentative job offer from the U.S. Army Recruiting Battalion as a human resource assistant, which he claims was withdrawn.
He then filed a Title VII Equal Employment Opportunity complaint alleging the withdrawal was due to discrimination and retaliation for voicing his concerns over alleged impermissible questions during the interview and security background investigation.
According to the lawsuit, the administrative judge for the EEOC admitted that the case was supposed to be adjudicated within 180 days, but had a heavy docket. Therefore, Gause is filing a writ of mandamus with the Southern District Court to compel the EEOC’s administrative judge to rule on outstanding discovery issues.
Gause seeks actual damages to be determined by the court, reasonable costs and attorney's fees. He is representing himself.
