Chinese insurance firm alleges shipping vessel damaged cargo

HOUSTON – An insurance company based in China is suing a shipping vessel, alleging damage to its cargo while en route from Shanghai to the port of Houston.

China Pacific Property Insurance Co. LTD of Shanghai filed a lawsuit Jan. 15 in the Houston Division of the Southern District of Texas against the M/V Star Kilimanjaro 

According to the complaint, on Aug. 25, 2014, China Pacific’s insurer, CIEC USA Inc. paid to have the M/V Star Kilimanjaro transport a cargo of ERW steel pipe from Shanghai to Houston, in good order and condition. On Oct. 19, 2014, when the cargo arrived in Houston, the suit says, much of the cargo was either dented, bent, flattened or otherwise physically damaged, sustaining $53,181.93 worth of damage–plus interest dating from Aug. 25, 2014.

China Pacific Property Insurance seeks damages, interest and costs and asks that the vessel Star Kilimanjaro be condemned and sold to satisfy the aforementioned damages. It is represented by attorney Robert C. Oliver of Sharpe & Oliver LLP in Houston.
