Beeville worker alleges United Energy Rentals failed to pay overtime

HOUSTON — A Beeville worker is suing his former employer, alleging failure to compensate for overtime.

Phillip Payne filed a complaint Feb. 9 in the Houston Division of the Southern District of Texas against United Energy Rentals LLC, Trinity Gate Guard Services Coporations Loc, and J.B. Roberson Jr., alleging violation of the Fair Labor Standards Act.

According to the complaint, Payne was hired by the defendant in 2014, during which time he worked as an hourly employee. In July 2014, he was promoted to a supervisor, and his pay changed from hourly to salaried of $84,000 annually, the suit states.

The lawsuit says that due to the defendant's repeated short staffing, Payne constantly would cover for others' job duties, but United Energy failed to compensate him for the overtime hours worked. Additionally, the suit states, the defendants failed to keep time records and willfully refused to pay Payne for his overtime work. The suit states Payne was terminated in October 2015.

Payne seeks damages for unpaid overtime, liquidated damages, interest and attorney fees, plus a jury trial. He is represented by attorney R. Edward Rosenberg of Morgado PA in Coral Gables, Florida.
