HOUSTON — An insurance company is suing two indemnitors, alleging breach of indemnity agreement.
International Fidelity Insurance Company filed a lawsuit Feb. 23, in the Houston Division of the Southern District of Texas against Bradley Daniel Louden of Minneapolis and Regina Grace Louden of League City, alleging they failed or refused to pay the plaintiff.
According to the complaint, on Aug. 20, International Fidelity had a loss of $78,612.81 due to the defendants' failure or refusal to pay. The plaintiff holds the Loudens responsible, the suit says, because they failed to respond to the plaintiff's demand for discharge and settle BBC’s claim for $75,000.
International Fidelity seeks compensation for all damages incurred, legal fees and expenses, amounts necessary to exonerate the plaintiff from all liabilities, pre-judgment and post judgment interest and costs of court. It is represented by attorneys Ryan D. Dry and Amy M. Bernadas of Krebs Farley PLLC in Plano.
