Couple sues commercial truck driver, employer

SHERMAN – A Texas couple has filed a suit against a truck driver and his employer after an accident allegedly left them injured.

Richard and Kristen Kroll filed a complaint on Feb. 23 in the Sherman Division of the Eastern District of Texas against Barrett Clyde Morrison and Call Us Logistics Inc., citing negligence.

According to the complaint, the plaintiffs allege that on March 14, 2014, in Denton County, they sustained personal injuries because of a collision between their vehicle and Morrison's tractor-trailer. The plaintiffs hold Morrison and Call Us Logistics Inc. responsible because Morrison allegedly disregarded the necessary measures prior and while driving and failed to adhere to traffic rules and regulations.

The couple alleges that Morrison disregarded a red light signal and was driving at an excessive speed, failed to apply brakes and proper control to avoid a collision, failed to comply to the traffic laws and regulations of the state of Texas, drove recklessly and other counts. They allege Call Us Logistics Inc. was negligent in assessing the driver's capacity to operate a commercial truck properly and safely, among other allegations.

The plaintiffs seek the following: compensation for all damages, court costs, and pre- and post-judgment interest. They are represented by John W. Pate and James Craig Orr, Jr. of Heygood, Orr & Pearson in Irving.
