SHERMAN — A Collin County couple is suing Hyundai, alleging a vehicle they bought was defectively designed.

Martin Woodall and Julie Woodall of Melissa filed a lawsuit March 4 in the Sherman District of the Eastern District of Texas against Hyundai Motor Company Ltd., and Hyundai Motor America, car manufacturers, alleging design defect and failure to protect.

According to the complaint, on Sept. 4, Martin Woodall and Julie Woodall were struck by another vehicle in Collin County, and Martin Woodall suffered serious injuries. The suit says he was properly seated and wearing his seat belt.

The plaintiffs allege Hyundai Motor Company and Hyundai Motor America are responsible because they failed to install safer alternative design, failed to provide adequate protection to the lower legs, failed to provide adequate restraint and safety during frontal impacts and failed to provide adequate side airbag coverage.

The Woodalls seek compensation for actual damages, prejudgment and post-judgment interest, costs of suit and all other relief the court deems proper. They are represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
