Acme Welding & Fabricating Inc. sues individual over alleged breach of contract

GALVESTON – A Galveston County company is suing a Magnolia man over allegations of unpaid debt.

Acme Welding & Fabricating Inc. filed a complaint on Feb. 25 in Galveston County District Court against George W. Johnson, doing business as Johnson Municipal Service, citing alleged breach of contract.

According to the complaint, the plaintiff alleges that it constructed a 5,000 gallon hydro tank for the defendant in 2014. The suit states that the plaintiff sent an invoice for $24,497 for fabrication fees and $575 for delivery and that Johnson has paid $7,497 toward the bill. The plaintiff holds Johnson responsible because the defendant allegedly failed to pay the full amount owed to it for services and materials delivered despite the demand letter sent by the plaintiff asking for settlement of the purportedly overdue balance.

The plaintiff seeks the following: compensation for all damages in the amount of $17,575, interest, all legal fees and any other relief as this court deems just and proper. It is represented by David L. Thornton of the Law Offices of David L. Thornton in Friendswood.
