Alleging she sustained injuries last year while eating a kolache, Dickinson resident Barbara Bullock has pursued legal action.
Galveston County court records show that Bullock sued Kolache Factory, Inc. and Bob Evans Farms, Inc. for $74,000 on Mar. 8, claiming the breakfast food contained foreign matter that cost her a pair of teeth.
The lawsuit explains that a company named Valero Title bought kolaches from Kolache Factory at the defendant’s 3813 Southwest Freeway location in Houston on Mar. 12, 2015. Valero Title, which is not a party, then delivered and served the kolaches at the complainant’s League City workplace.
“The plaintiff then bit into a sausage and gravy kolache that contained a hidden piece of plastic and broke (two) of her teeth and sustained major nerve damage to her jaw/teeth/mouth,” the original petition says.
Bullock faults Bob Evans Farms on a claim the respondent sold Kolache Factory sold the pastries prepackaged.
She seeks a jury trial.
