Customer blames Wal-Mart's alleged negligence for injuries

GALVESTON – A Harris County man has filed suit against a retail chain over allegations he slipped and fell on a foreign substance while carrying his daughter.

Michael Smith, individually and as next friend of Averee Smith, filed a complaint on Dec. 10 in Galveston County District Court against Wal-Mart Stores Texas LLC, citing alleged negligence.

According to the complaint, the plaintiff alleges that on Oct. 24, 2015, he slipped and sustained body injuries while visiting a Walmart store while carrying his daughter. The suit states both plaintiffs suffered injuries. Smith holds Wal-Mart Stores Texas LLC responsible because the defendant allegedly neglected its duties to their customers to maintain the premises in a reasonably safe condition.

The plaintiff seeks the following: compensation for all damages, medical expenses, lost wages, all legal fees and any other relief as this court deems just and proper. He is represented by M. Paul Skrabanek and Michael E. Pierce of Pierce Skrabanek Bruera PLLC in Houston.
