Client alleges Allstate refused to pay insurance benefits

GALVESTON — A Galveston woman is suing Allstate, alleging refusal to pay benefits for injuries she suffered in an auto accident.

Tonya Huckaby of Galveston filed a lawsuit Dec. 21 in Galveston County District Court against Allstate Insurance Company, alleging breach of contract, failure to uphold Americans with Disabilities Act regulations.

According to the complaint, on Aug. 5, Huckaby sustained injuries and damages to her property in a vehicular accident. The plaintiff alleges Allstate Insurance Company told the plaintiff the expenses to compensate her are is well over the limit of liability as per stated in the plan policy.

The plaintiff seeks more than $1 million in damages, past and future medical expenses associated with the accident including interest, all legal fees, a jury trial, plus any other relief the court deems proper. She is represented by attorneys David W. Bergquist and Nicholas M. Wills of Bergquist Law Firm in Houston.
