Man alleges GM's negligence caused wife's death in auto accident

MARSHALL – A Ben Wheeler man is suing an auto manufacturer alleging that it knowingly manufactured vehicles that are not crashworthy.

Phillip Hillard Jr. filed a complaint on March 17 in the Marshall Division of the Eastern District of Texas against General Motors LLC, citing negligence.

According to the complaint, the plaintiff alleges that on Nov. 18, 2015, his late wife, Anastasia Hillard, sustained body injuries that resulted in her death when the 2012 Chevrolet Captiva she was driving was struck by a vehicle that crossed the median on SW Loop in Tyler. The suit states she was wearing a seat belt and that the car failed to protect her. The plaintiff holds General Motors LLC responsible because the defendant allegedly manufactured vehicles without properly testing their designs for being crashworthy.

The plaintiff seeks the following: compensation for all damages, interest at the maximum rate allowed by the law, all legal fees and any other relief as the court deems just and proper. He is represented by E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
