Tyler woman accuses former employer of age discrimination

TYLER — A former employee is suing a school company, alleging age discrimination caused her to be fired.

Brittany Poster filed a lawsuit March 30, in the Tyler Division of the Eastern District of Texas against JBJLATBD LLC, doing business as Oak Hill Montessori School in Tyler, alleging wrongful denial of the plaintiff's claims for plan benefits, violation of the Family and Medical Leave Act, violation of workers compensation acts and wrongful termination.

According to the complaint, on May 8, 2015, Poster, a teacher of 3-year-olds at Oak Hill, suffered injuries to her arm and filed for a claim under the employee injury plan, but was denied. After being denied of the plan benefits, the suit says, the plaintiff experienced discrimination when her total hours were cut to 10 hours per week and she was ultimately laid off. 

The plaintiff alleges the defendant denied her rights to the employee injury benefit plan and terminated her employment due to her hand injury as well as her age.

Poster seeks past and future medical expenses, lost earnings and lost earning capacity in the past and future, interest at the maximum rate, payment of benefits, exemplary damages, all legal fees and any other relief the court deems just.
