Texas business alleges Louisiana energy company breached contract

GALVESTON — A Houston business is suing a Louisiana energy company, alleging breach of contract and product liability.


Total Safety U.S. Inc. and Zurich Services Corporation filed a lawsuit April 12, in the Galveston Division of the Southern District of Texas against Crescent Energy Services, LLC, alleging the Louisiana company failed to defend the plaintiff when one of its employees sued Total Safety.

According to the complaint, on June 8, 2012, Total Safety and Zurich Services were sued by Joseph Molander, who was injured while performing work as a platform operator. The plaintiffs allege Crescent Energy is responsible because the defendant is under contract with plaintiff to "indemnify, defend and save harmless" Total "from and against all claims, demands or causes of action of every kind and character for bodily injury" but failed to do so.

The plaintiffs seek all damages, plus interest from the date of breach until judgment, pre-judgment and post-judgment interest, all legal fees and any other relief the court deems just. They are represented by attorneys Adraon D. Greene and Juvie A. Cruz of Galloway, Johnson, Tompkins, Burr & Smith in Houston.
