Cook alleges Mount Pleasant restaurant failed to pay overtime

MARSHALL — A cook is suing a Mount Pleasant restaurant, alleging unpaid overtime wages.

Jose Delgado of Mount Pleasant, filed a lawsuit, individually and on behalf of all others similarly situated, March 18,in the Marshall Division of the Eastern District of Texas against Consuelo Mercado and Two Senoritas Inc., alleging violations of the Fair Labor Standards Act by failing to pay overtime.

According to the complaint, Delgado and others worked more than 40 hours per week but did not receive any overtime pay for those extra hours. The plaintiff alleges Mercado and Two Senoritas failed to pay overtime despite knowing the total hours their employees worked each week.

Delgado seeks a trial by jury, unpaid wages, liquidated damages, all legal fees and any other relief the deems just. He is represented by attorney William S. Hommel Jr. of Hommel Law Firm in Tyler.
