Harris County worker alleges hauling business violated overtime rules

HOUSTON — A truck driver is suing a hauling company, alleging violations of federal overtime regulations.

Ernest Cano filed a lawsuit April 22, in the Houston Division of the Southern District of Texas against Nature's Second Chance Hauling LLC,  alleging violations of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, Cano worked for more than 40 hours per week but was not paid any overtime at the proper rate as defined by the FLSA. The plaintiff alleges the defendant failed to maintain accurate employee pay records and failed to pay Cano overtime for all his hours worked of more than 40 per week.

Cano seeks a trial by jury, all unpaid overtime wages, liquidated damages equal to the unpaid overtime wage, interest, all legal fees and any other relief the court deems just. He is represented by Ryan B. Gross of The Gross Law Firm PLLC in Houston.
