Three employees accuse outdoor deck business of ignoring overtime rules

HOUSTON — Three Montgomery County employees are suing a Conroe outdoor deck and patio business, alleging failure to pay overtime. 

Rodrigo Robles, Jose G. Robles and Martin Cruz, individually and on behalf of all others similarly situated, filed a class action lawsuit April 28 in the Houston Division of the Southern District of Texas against Houston Deck & Shade LLC and Loren Goodrich, alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, between March 2012 and February 2016, Rodrigo Robles, Jose G. Robles and Cruz worked for more than 40 hours per week but received no overtime wages. The plaintiffs allege the defendants paid their employees the regular hourly rate instead of the proper overtime rate as defined by the FLSA.

The plaintiffs seek a trial by jury, all unpaid overtime compensation, liquidated damages, interest, all legal fees and any other relief the court deems just. They are represented by attorneys Melissa Moore, Rochelle Owens and Curt Hesse of Moore & Associates in Houston.
