Former Phoenix Technology Services USA Inc. employee alleges overtime pay violations

HOUSTON – A Harris County man alleges he was terminated in retaliation for opposition of his employer's decision regarding overtime pay and employee status.

Blake Kniss filed a complaint on April 27 in the Houston Division of the Southern District of Texas against Phoenix Technology Services USA Inc. citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was terminated on Feb. 8 when he voiced his opinion about the defendant transferring its employees from employee to consultant status. The plaintiff holds Phoenix Technology Services USA Inc. responsible because the defendant allegedly opted to change employee status in order to avoid paying overtime pay.

The plaintiff requests a trial by jury and seeks back pay and front pay, reinstatement, compensatory damages, liquidated damages, interest, all legal fees and any other relief as this court deems just. He is represented by Melissa Moore, Rochelle Owens and Curt Hesse of Moore & Associates in Houston.
