Motorist alleges trucking company caused crash

MARSHALL — A motorist is suing a trucking company, alleging one of the defendant's drivers caused a crash that resulted in injuries.

Demon Savage filed a lawsuit April 6, in the Marshall Division of the Eastern District of Texas against GKD Management LP, doing business A&G Commercial Trucking, alleging the trucking company's driver failed to exercise caution while operating his vehicle.

According to the complaint, on Jan. 13, Savage sustained injuries when cargo flew off an A&G tractor trailer and crashed through his windshield on state Highway 37 near Mineola. The plaintiff alleges Shawn Taylor, the defendant's driver failed to exercise caution and failed to properly secure his cargo. 

The suit says Turner did not stop the tractor trailer to check on Savage who would suffer physical pain, mental anguish, physical impairment and loss of earning capacity. 

Savage seeks a trial by jury, judgment against the defendant, interest, all legal fees, and any other relief the court deems just. He is represented by attorneys Daryl L. Derryberry and Tab E. Lawhorn of Derryberry Zips Wade Lawhorn PLLC in Tyler.
