Employee alleges Houston business failed to pay overtime

HOUSTON — An employee is suing a Houston company, alleging it doesn't follow federal regulations in paying overtime. 

Jose Espinoza, individually and a on behalf of others similarly situated, filed a class action lawsuit May 6 in the Houston Division of the Southern District of Texas against Modern Method Gunite Inc., alleging violation of the Fair Labor Standards Act in failing to fairly compensate employees.

According to the complaint, Espinoza, who started working for Modern Method in January 2009, has often worked more than 40 hours per week but has not been paid any overtime compensation. The plaintiff alleges Modern Method failed to pay its employees overtime wages for any time worked in excess of 40 hours per week.

Espinoza seeks all unpaid overtime compensation, liquidated damages, service award for the plaintiff, interest at the highest legal rate, all legal fees and any other relief the court deems just. He is represented by attorney David I. Moulton of Bruckner Burch PLLC in Houston.
