HOUSTON – A Texas consumer is suing a credit report agency, alleging its report on his credit contained false information.
Anthony Welch filed a lawsuit Jan. 15 in the Houston Division of the Southern District of Texas against Experian Information Solutions, Transunion LLC, alleging violation of the Fair Credit Reporting Act.
According to the complaint, Welch was denied credit from Citibank. The suit says on Dec. 16, 2013, he requested a credit report from Experian, which requested on Jan. 6, 2014 that Welch provide additional identifying information.
On Jan. 22, 2014, according to the complaint, Experian sent Welch a credit report that contained false information, as well as an incorrect Social Security number and false, derogatory collection accounts attributed to him.
On Dec. 1, 2015 Welch says he sent Experian a letter asking them to remove tax lien that was 10 years old and had expired, according to a statute of the Federal Tax Lien. On Dec. 3, 2015, the suit says Welch called Experian and spoke to a Jennifer King, who said she would look into the tax lien time frame. According to the suit, Welch received two e-mails stating his credit report was accurate and that nothing would change.
Welch seeks a jury trial, actual and statutory damages in an amount to be determined by the court, attorney fees and costs. He lists no legal representation.
