Customer alleges restaurant's negligence caused injuries

GALVESTON — A customer is suing Kona Grill, alleging insufficient measures were taken to prevent injuries. 

Dustin Moore filed a lawsuit May 12 in Galveston County District Court against Kona Grill, Inc. alleging negligence in that the restaurant failed to warn the plaintiff of a foreign substance on the floor.

According to the complaint, on Feb. 28, Moore slipped and fell due to a puddle of water on the floor at the Kona Grill restaurant in Friendswood. The plaintiff alleges Kona failed to clean the floor and did not provide adequate warning to customers using the public walkway.

The suit says the plaintiff sustained pain, suffering, mental anguish and lost wages.

Moore seeks monetary relief of up to $100,000, all damages, interest, legal fees and any other relief the court deems just. He is represented by attorney Christian G. Alba of The Alba Law Firm in Alvin.
