BEAUMONT — An employee is suing a Beaumont business, alleging negligence caused him a severe foot injury.
Richard K. Phelps of Lumberton filed a lawsuit May 12 in Jefferson County District Court against Zachry Industrial, Inc., J.V. Industrial Companies Ltd., Trans-Global Solutions, Inc. doing business Beaumont Bulk Terminal Inc. Kinder Morgan Energy Partners LP, and ExxonMobil Oil Corporation, alleging negligence in failing to maintain their equipment.
According to the complaint, on Feb. 16, 2015, Phelps, who was working as a mechanic aboard a vessel operated by ExxonMobil, was involved in an accident that resulted in the amputation of the hallux of his left foot. The plaintiff alleges the defendants failed to maintain the ship loader that caused injuries to the plaintiff.
The suit says the plaintiff sustained physical pain and suffering, mental anguish, impairment and disfigurement, loss of earnings and medical bills.
Phelps seeks a trial by jury, judgment against the defendants, interest, all legal fees and any other relief the court deems just. He is represented by attorneys Paul F. Ferguson of The Ferguson Law Firm LLP in Beaumont, and Curtis L. Soileau of Beaumont.
