TEXAS – A Florida-based photograph alleges that a Houston business published copies of his copyrighted works without his consent.
Ted VanCleave filed a complaint on May 18 in the U.S. District Court for the Southern District of Texas against Capital Jet Inc. alleging copyright infringement.
According to the complaint, the plaintiff alleges that he suffered damages as a result of his works being used without his permission by the defendant on the defendant's website in 2013 and 2014.
The plaintiff requests a trial by jury and seeks statutory damages for up to $150,000 for each infringement, to enjoin the defendant, all legal fees and any other relief as the court deems just. He is represented by Mathew K. Higbee of Higbee & Associates in Santa Ana, California.
