Employee alleges restaurant failed to prevent vehicle assault by customer

GALVESTON — An employee is suing a Santa Fe restaurant and customer, alleging it failed to prevent an assault by a customer.

Richard Miller filed a lawsuit May 25 in Galveston County District Court against Mickey Miller and Rooster's Orange Bar, alleging negligence in failing to provide proper security.

According to the complaint, on June 22, 2014, Richard Miller sustained injuries when a pickup truck driven by Mickey Miller crashed into Rooster's Orange Bar. The plaintiff alleges the defendant had been asked to leave the restaurant and became irate. Mickey Miller drove his truck into Rooster's, injuring another customer, the suit says, and when he again attempted this maneuver, Richard Miller stepped in front of the pickup and was injured.  

The plaintiff alleges Rooster's Orange Bar failed to provide adequate security. He says he sustained injuries, disfigurement, impairment, mental anguish, medical expenses and lost wages.

Richard Miller seeks a trial by jury, monetary relief between $200,000 and $1 million, all damages, interest, all legal fees and any other relief the court deems just. He is represented by attorney David B. Swick of Smith & Hassler in Houston.
