Customer alleges grocery's negligence caused her to fall

GALVESTON — A Galveston County woman is suing a grocery and its owner, alleging negligence caused her to fall and sustain injuries.

Robin Westphal of Friendswood, filed a lawsuit June 2 in Galveston County District Court against HEB Grocery Company LP, H.E. Butt Grocery Company, Friendswood H-E-B alleging negligence in failing to keep the store's floor free from any substance that could cause an accident.

According to the complaint, on June 2, 2014, Westphal sustained a left foot injury after falling on the floor while shopping at Friendswood H-E-B. The plaintiff alleges the defendants failed to clean the puddle of water on the floor that accumulated due to a faulty air conditioning duct.

The suit says the plaintiff sustained mental and physical pain, impairment and medical expenses for drugs and a hospital services.

Westphal seeks all damages, all medical expenses, all legal fees and any other relief as this court deems just. She is representing herself.
