Driver alleges he is owed wages from Executive Enterprices Inc.

HOUSTON – A deliver driver alleges he was required to work more than 40 hours per week but was not paid overtime.

Ryan Hollerman filed a complaint on June 1 in the Houston Division of the Southern District of Texas against Excel Executive Enterprices Inc. and Jeffrey P. Martin alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that, between May 2015 and December 2015, he worked for more than 40 hours per workweek without being paid any overtime wages. The plaintiff holds Excel Executive Enterprices Inc. and Martin responsible because the defendants allegedly failed to pay any overtime compensation to plaintiff in violation of the FLSA.

The plaintiff requests a trial by jury and seeks all unpaid overtime compensation, liquidated damages equal to the unpaid overtime wages, all legal fees and any other relief as this court deems just. He is represented by Kelly E. Cook and Brad Wyly of Wyly & Cook in Houston.
