Truck operator alleges demolition company failed to pay overtime

HOUSTON — A dump truck operator is suing a Houston demolition business, alleging failure to pay overtime. 

Ernesto Aponte filed a lawsuit May 27 in the Houston Division of the Southern District of Texas against Robles Demolition Services LLC and Ramiro Robles, alleging violation of the Fair Labor Standards Actin in failing to fairly compensate employees.

According to the complaint, between July 2014 and 2016, Aponte worked for more than 40 hours per week as a dump truck operator but was paid at the regular rate. The plaintiff alleges the defendants failed to pay overtime wages at the legal rate as defined by the FLSA of time and half for any hours worked past 40 per week.

Aponte seeks a trial by jury, unpaid overtime wages at the applicable rate, liquidated damages in an equal amount, interest, all legal fees and any other relief the court deems just. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law Firm in Houston.
