HOUSTON — An employee is suing a Houston sign business, alleging failure to pay overtime.
Lake Elliott filed a lawsuit May 26 in the Houston Division of the Southern District of Texas against Diamond J Signs Inc., and Jim Lowrey, alleging violation of the Fair Labor Standards Act in failing to fairly compensate the plaintiff for his overtime work.
According to the complaint, between June 1, 2012 and Oct. 15, 2015, Elliott was not paid any overtime premium at the legal rate for work rendered of more than 40 hours per week as a repairer and installer of signs. The plaintiff alleges the defendants paid Elliott on an hourly basis but did not pay him any overtime premium at the rate of time and a half as defined by the FLSA.
Elliott seeks a trial by jury, compensatory damages, liquidated damages, all legal fees and any other relief the court deems just. He is represented by attorneys Thomas Padgett Jr., Charles L. Scalise and Daniel B. Ross of Ross Law Group in Bellaire.
