Customer blames Kemah restaurant for injuries

GALVESTON — A Harris County woman is suing the owners of a Kemah restaurant, alleging their negligence allowed a railroad crossing arm to hit her.

Melissa Jones filed a lawsuit June 14 in Galveston County District Court against Landry's Restaurants Inc., Landry's Crab Shack Inc., Landry's Seafood Kemah Inc., and Landry's Seafood Inn & Oyster Bar - Kemah Inc., alleging negligence in failing to keep their premises reasonably safe for customers.

According to the complaint, on Feb. 14, Jones sustained injuries when the railroad arms fell on her head while she was crossing the tracks near the Bubba Gump restaurant in Kemah. The plaintiff alleges the defendants failed to provide adequate warning to Jones and generally failed to keep their premises safe for patrons.

The suit says the plaintiff sustained physical and mental injuries.

Jones seeks a trial by jury, damages between $200,000 and $1 million, plus interest, all legal fees and any other relief as the court deems just. She is represented by attorney Mark B. Levin of Stern Law Group in Bellaire.
