The complaint was lodged by Frontier Southwest Incorporated, doing business as Frontier Communications of Texas, Inc., in the District Court of Harris County, Texas on April 30, 2025. The lawsuit targets Webber, LLC for allegedly failing to take necessary precautions to protect Frontier's underground cables during their operations.
According to the details laid out in the case documents, the incident occurred on or around July 11, 2023, at a site near 24207 FM 2100 in Huffman, Texas. Frontier claims that Webber's negligence led to significant damage to its utility infrastructure while they were engaged in digging and boring activities. The plaintiff argues that Webber did not comply with legal requirements for locating and protecting existing underground utilities before commencing their work. This oversight allegedly resulted in disruptions to essential telecommunications services provided by Frontier and necessitated costly repairs.
Frontier's petition outlines several causes of action against Webber, including trespass and multiple forms of negligence such as negligent hiring and supervision. The complaint states that "Defendant owed a duty to Frontier to exercise reasonable care" but failed to do so by not maintaining a proper lookout or proceeding safely during their operations. As a result of these alleged failures, Frontier claims it suffered damages amounting to no less than $15,761.80.
The plaintiff is seeking monetary relief from Webber totaling $250,000 or less. They are asking for compensation for the direct damages incurred due to the incident along with pre- and post-judgment interest as allowed by law. Additionally, Frontier requests coverage for all taxable court costs and any other relief deemed appropriate by the court.
