Landscaper accuses employers of failing to pay overtime

HOUSTON — A Harris County landscaper is suing his employers, alleging failure to pay overtime. 

David Barker filed a class action lawsuit, individually and on behalf of other employees similarly situated, June 20 in the Houston Division of the Southern District of Texas against Van Sant Landscape Management and Jon Van Sant, alleging failure to comply with provisions of Fair Labor Standards Act and the Texas Minimum Wage Act.

According to the complaint, Barker regularly worked many hours more than 40 hours per week without receiving the minimum wage and proper overtime compensation for all hours he worked. The plaintiff alleges the defendants willfully failed to pay minimum wage and overtime premium at the rate of one-and-one-half times the regular wage for all hours worked in excess of 40 hours per week and failed to accurately record all the hours which he worked.

Barker seeks a trial by jury, declaration the defendant violated the FLSA, unpaid overtime compensation, liquidated damages, attorney fees, legal costs and expenses, and such other relief as allowed by law.
