Customer alleges Whataburger negligence led to child's injuries

BEAUMONT — A Beaumont woman, as next friend of a minor, is suing a hamburger restaurant, alleging its negligence led to injuries to the minor.

Patricia Washington, as next friend in behalf of minor J. Stoker filed a lawsuit June 21 in Jefferson County District Court against Burgers of Beaumont 1 Ltd., doing business as Whataburger and Utmost Management Inc., alleging negligence in breaching their duty to exercise ordinary care to keep their premises safe.

According to the complaint, on June 25, 2014, J. Stoker was severely injured when she slipped and fell due to a large puddle of water on the floor near the Whataburger soda fountain. As a result, she has suffered physical pain, mental anguish, medical expenses and future diminished earning capacity, the suit says. 

The plaintiff alleges the defendants failed to give adequate warnings, failed to reduce or eliminate the dangerous condition and did not post any "wet floor" signs.

Washington seeks a trial by jury, monetary relief between $100,000 and $200,000, plus legal interest, pre-judgment interest, legal costs and other relief to which she is entitled. She is represented by attorney J. J. Bragg of Beaumont.
