Refuse collector alleges Galveston property owners owe $1 million

GALVESTON — A refuse collector is suing a Santa Fe couple, alleging they owe more than $1 million. 

Galveston County Landfill TX LP filed a lawsuit July 6 in Galveston County District Court against Kenny Wagner and Shawn Wagner of Santa Fe, alleging breach of contract in failing to comply with the terms of the settlement agreement and the final settlement.

According to the complaint, Landfill TX has suffered damages in an amount within the jurisdictional limits of the court regarding a landfill project across the street from the defendants. The plaintiff alleges the Wagners refused to convey the subject property as promised under the terms of the original agreement, failed to close the sale of the property, failed to vacate it and failed to timely perform its obligations under the final settlement.

Galveston County Landfill seeks a trial by jury, an order the defendant fulfill the final settlement, monetary relief of more than $1 million, court costs, expenses, pre- and post-judgment interest, attorney fees and all other relief to which it is justly entitled. It is represented by attorneys Joel T. Towner and Troy Ford of Beck | Redden LLP in Houston.
