Construction company alleges project owners, contractor, insurer owe $113,000

GALVESTON — A League City construction company is suing project owners, a contractor and an insurance firm, alleging they owe more than $113,000 for work on a construction project. 

Anaya Enterprises LLC filed a lawsuit July 6 in Galveston County District Court against Hutton Team LLC, Family Dollar Stores of Texas LLC, North Gate Square LLC, Hutton Construction, Inc. and Hartford Fire Insurance Company, alleging they breached an oral agreement to pay for worked performed.

According to the complaint, Anaya has suffered monetary damages for not being paid for the worked performed and the materials furnished to defendants owners' project at 2928 Broadway, Galveston, in the amount of $113,037.15. 

The plaintiff alleges the defendants wrongfully terminated the subcontract agreement, and have failed and refused to pay the amounts due under the subcontract agreement.

Anaya Enterprises seeks a trial by jury, that the defendants be required cited to appear and answer this complaint, judgment of $113,037.15, judgment establishing its lien on the improvements and property, attorney fees and legal costs, pre- and post-judgment interest and such other relief to which it is entitled to receive.
