Couple alleges Price Rite's negligence led to a car crash

HOUSTON — A Montgomery County couple is suing Price Rite and two Montana residents, alleging their negligence caused a car crash that led to injuries for the husband.

Roxi Walker and William Walker filed a lawsuit July 6 in the Houston Division of the Southern District of Texas against Jamie K. Cole of Helena, Montana, Price Rite Medical Equipment Inc. Price Rite Drug LLC and Randy Harrington, alleging negligence in that insufficient measures were taken to prevent injuries. 

According to the complaint, on July 7, 2014, Roxi Walker was stopped in her auto and waiting for traffic at the corner of West Oaks and Seventh Avenue in Bozeman, Montana, when Jamie Cole negligently collided with the rear end of her vehicle. The suit says this caused Walker to sustain lost wages and medical expenses, pain, emotional distress, mental anguish and anxiety. 

The lawsuit says William Walker suffered loss of family income and loss of consortium. 

The plaintiffs allege Cole failed to exercise duty of reasonable care while driving her motor vehicle. The suit says she was employed by at least one of the defendants at the time of the crash.

The Walkers seek trial by jury, judgment of at least $75,000 and all other relief as the court and jury deem just and proper. They are represented by attorney William C. Herren of Herren Law Office in Houston.
