Construction worker accuses drywall business of failing to pay overtime

HOUSTON — A construction worker is suing a Houston drywall business, alleging failure to pay proper overtime compensation.

Antonio Barron, individually and for all all other similarly situated employees filed a class action lawsuit July 7 in the Houston Division of the Southern District of Texas against Whiteroc Drywall LLC alleging violation of the Fair Labor Standards Act.

According to the complaint, during Barron's employment with Whiteroc from November 2015 until Feb. 27, 2016, he regularly worked 50 hours or more per week but was not paid any overtime premium for hours worked more than 40 per week. Instead, the suit says, he was paid straight time for all hours worked. 

The plaintiff alleges Whiteroc Drywall failed to pay the him the required overtime premium at the rate of time and one-half of his hourly rate for all hours worked in excess of 40 hours per week.

Barron seeks trial by jury, unpaid overtime wages, an equal amount as liquidated damages, pre-judgment interest, all legal costs and attorney fees and for such relief as the court deems just and equitable. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law Firm in Houston.
