Woman alleges handle and valve assembly malfunctioned on Blue Rhino exchange tank

MARSHALL – A Mineola woman alleges a propane exchange tank purchased for her grill malfunctioned and caused her injuries.

Daphne R. Hatcher filed a complaint in the Marshall Division of the Eastern District of Texas against Ferrellgas LP, doing business as Blue Rhino, Rotarex Inc. North America and R4 Technical Center North Carolina LLC alleging negligence, strict liability for defective design, manufacture and marketing and other counts.

According to the complaint, the plaintiff purchased a Blue Rhino propane exchange tank for her grill. She alleges that on July 15, 2014, she was using the tank when suddenly and without warning, the handle and valve assembly blew off of the tank with great force, causing her to propel backward and sustain severe and disabling injuries. The plaintiff holds Ferrellgas LP, Rotarex Inc. North America and R4 Technical Center North Carolina LLC responsible because the defendants allegedly negligently manufactured the tank, failed to inspect the tank's components and failed to ensure that it was suitable to be returned to service.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, for damages in an amount that will reasonably compensate her, costs of suit, pre- and post-judgment interest and such other relief to which the she may show herself to be justly entitled.
